DOMESTIC
Our lawyers provide a broad range of electricity
and hydrocarbon marketing services to a variety
of clients. Several of our lawyers have been
placed on short, medium and long term secondments
with clients, both on the trading floors of
energy marketing companies and in the marketing
groups of exploration and production companies.
Thackray Burgess assists clients in dealing
with the many risks and participation in the
many opportunities which gas and electricity
deregulation has brought to the Province of
Alberta and to other jurisdictions within
Canada. In addition, to help bring legal certainty
to the contracting processes of their clients,
they have aided in the establishment of mid
and back office systems and procedures to
effectively capture transactions.
Our lawyers have presented numerous papers
and seminars to the Canadian Bar Association,
the energy industry and clients on various
topical matters. Recent presentations involved
issues such as electricity de-regulation in
Alberta, electricity trading enablement in
Alberta, interpretation of force majeure under
energy marketing contracts and the workings
of various industry standard marketing contracts.
INTERNATIONAL
Our lawyers have provided energy marketing
services in a variety of jurisdictions throughout
the United States and the world in regulated,
semi-regulated and deregulated business environments.
Our broad range of experience and extensive
expertise with such transactions in a variety
of jurisdictions at different stages of the
regulation/deregulation process gives us a
unique skill set, which we enjoy putting to
effective use on behalf of our clients.
Two of our lawyers have worked on behalf of
a client, an international electricity and
natural gas trader and retailer, in various
European jurisdictions from a base in the
Netherlands . They have assisted with establishing
business operations throughout Western Europe
and with the identification of risks and opportunities
as energy de-regulation expands in continental
Europe. The North American experience in gas
and, most recently, power de-regulation has
allowed us to provide our client with much
assistance in capturing opportunities arising
from the deregulation process and constructing
its trading and more complex "structured"
transactions. In addition, our experience
with de-regulated environments has proved
invaluable representing our client in various
industry groups in respect of developing standard
energy trading documentation for use across
the European economic union.
