Last night in Calgary, Thackray Burgess was awarded
TOP LAW FIRM at the 2008 Energy-TV Awards. The
event was timed well as this is Global energy
week in Calgary, where the best and brightest
from the national and international energy industry
gather each year. The awards gala took place at
the Hyatt Regency Calgary and was attended by
hundreds of leaders in the Nation’s energy
sector. Winners were chosen by internet and by
their peers.
“We are thrilled to be recognized in this

THACKRAY BURGESS ANNOUNCES NEW EDUCATION SERIES
FOR CLIENTS
January 2008 marks the beginning of a new client
development initiative by Thackray Burgess. The
firm is launching an education series consisting
of several Lunch & Learn topics for valued
clients. During the first quarter of 2008, Thackray
Burgess will be offering information sessions
focused on various ERCB (formerly EUB) topics
presented by Tamara Bews, former EUB legal counsel.
The approach to delivering these sessions is flexible
and can be tailored to client needs. Tamara already
has several Lunch & Learns booked with Energy
clients at their offices and Thackray Burgess
will also be hosting a Lunch & Learn in both
January and February.

GROUP ANNOUNCES UNIVERSITY OF CALGARY PRIZE IN
LAW
The firm is excited and honoured to support the

THACKRAY BURGESS TAKES LEAD IN EMERGING GREENHOUSE
GAS EMISSIONS MARKET
Calgary law firm participates in largest deal
to date for emissions credits.
Thackray Burgess announced its participation
in one the most significant greenhouse gas emissions
credit transactions to date. Mr.
David Reschke, a lawyer and shareholder with
Thackray Burgess, served as lead counsel to the
number one (in terms of both power generation
and number of customers) Dutch energy company,
n.v. Nuon, who acquired several million tonnes
of Certified Emission Reductions (CERs) over a
2005-07 delivery period.
Nuon completed the transaction late September,
2004 through its subsidiary, n.v. Nuon Energy
Trade & Wholesale. The transaction was with
AgCert Canada Co. of Edmonton, Alberta, Canadian
affiliate of Florida based AgCert International,
LLC.
The exact number of CERs and the price were not
disclosed but indications are that the transaction
is the largest done world wide to date in the
new international emissions market developing
in the wake of Kyoto.
CERs are greenhouse gas emission allowances recognized
under the Kyoto Protocol for compliance with greenhouse
gas reduction targets. They are generated by the
implementation of "clean development mechanisms"
or technologies in certain developing countries.
AgCert's core business is the creation of CERs
through implementing modified animal waste management
practices at agricultural installations.
Thorsten Ansorg, Head of Environmental Products
at Nuon who spearheaded the transaction, stated,
"CERs are an ideal compliance tool for Nuon.
Pure EU allowances will expire by definition at
the end of the 2005-07 trading period, but CERs
are transferable into the 2008-12 period. Therefore
this transaction was a significant risk management
milestone for Nuon and it's customers."
The Europeans have instituted a pre-Kyoto, 2005-07
greenhouse gas compliance regime as of January
1, 2005 whereby some 7,200 facilities will have
their greenhouse gas emissions capped. The EU
Emissions Trading System, and the related National
Allocation Plans of each EU member state, allocate
emission allowances among those facilities, and
allows such facilities to meet their greenhouse
gas emissions targets by using the Kyoto based
flexible investment mechanisms (such as the clean
development mechanism) or acquiring the related
emission credits such as CERs.
Mr. Reschke's involvement with the transaction
resulted from his experience in the European power
industry and its "green power" offshoot.
"Working with renewable and green-power transactions
in Europe gave me the necessary expertise to structure
and negotiate these types of international carbon
emissions transactions," says Mr. Reschke.
Also saying, "With the European's EU ETS
[European Union Emissions Trading System] in place
as of the start of 2005, the international market
is becoming very active. Affected Canadian businesses
have to get into this fast moving emissions game
sooner rather than later so they are not disadvantaged."
