Western Canada Renewable Energy Forum - Investing
in the Growth of Green Projects

THACKRAY BURGESS SEMINAR ON FREEHOLD SURFACE RIGHTS
RECEIVES ENTHUSIASTIC RESPONSE.
Thackray Burgess lawyers recently presented a
seminar to over 40 participants on the topic of
Alberta Freehold Surface Rights.
The seminar focused on the scenario of an oil
company lessee under a freehold surface lease
taken from a third party fee simple owner, with
particular emphasis on the practical day to day
issues encountered with the administration of
such leases.
Discussions included:
An
introduction to the history of land ownership
in Alberta, the Torrens system and the proper
caveating of surface interests
An
overview of the freehold surface lease, its terms,
covenants, special clauses and documentation requirements
for a proper surface file
An
overview of regulatory regimes affecting surface
rights, namely the Surface Rights Board, AEUB
and Alberta Environment
Participant feedback was positive, noting the
"cross-functionality of the materials"
for a diverse oil and gas audience that included
employees and consultants from legal, surface
and mineral land departments, accounting, regulatory
affairs, construction, reclamation, and renewable
energy. Another participant remarked how the seminar
was able to, "increase the organization's
sensitivities to the myriad of issues in this
area of the law."
